Terms and Conditions.

Your Agreement is with Shark Designs.

Please read these Terms & Conditions carefully before making a course purchase with us. Once the deposit, or full course payment has been made to Shark Designs, and confirmation can be made that the course purchase is genuine, with the full name and address of the client(s), the client(s) will have then entered a binding contract on the basis of these Terms & Conditions.

"Shark Designs" means Shark Designs, 56 Gassons Road, Snodland, Kent, ME6 5RW.

1. Agreement.

Agreement on the basis these Terms & Conditions arise upon the fulfilment of all of the following: receipt by Shark Designs of the full payment or specified deposit; receipt by Shark Designs of the full names and addresses of all the persons who are to attend the course; clearance of the full payment or deposit into Shark Design’s bank account; acceptance by Shark Designs in writing.

Shark Designs reserves the right, in its absolute discretion and without the need to give reasons, to refuse to accept a course booking. In such circumstances no agreement arises and Shark Designs will return any payment accompanying the booking.

The agreement is between Shark Designs and the client(s) and is the sole agreement between those parties. No variation of these Terms & Conditions shall be applicable unless agreed in writing by Shark Designs before the relevant course.

The agreement is governed by English law.

2. Payment.

Full payment for the course is required for any courses that are due to start within 4 weeks, or under, from the accepted date of booking. No deposit is taken in this case, and the full amount is payable.

For courses due to start 4 weeks, or greater, from the accepted date of booking, the client(s) will be billed 20% of the course fee, or the deposit specified. If any fees are still outstanding 4 weeks prior to the courses commencement, the client(s) will be sent an email reminder at 4 weeks and then 3 weeks prior to the course start date, prompting payment of the remaining 80%, or any outstanding balance needed to make full payment of the course. Email is not guaranteed to be delivered, so it is the client(s) ultimate responsibility to check when payments are required.

Any outstanding balance of fees still owing must be paid in full, 2 weeks prior to the commencement of your course. If not so paid, Shark Designs reserves the right to treat the agreement as cancelled by the client(s) and the client(s) will forfeit any deposit or payments that they have made.

3. Prices.

Whilst every effort is made to limit prices to those stated on the Shark Designs web site, Shark Designs reserves the right to alter prices should its costs in hosting a course increase for reasons beyond its reasonable control (including, without limitation, the cost of labour, transport and materials).

In the event that a price is altered the client(s) will be notified as soon as reasonably possible and the balance of the altered price will be payable on the same terms as was the original price.

In the event of the price being thus increased by 15% or more the client(s) may opt to cancel the booking and will then be entitled to a refund of all monies paid.

4. Cancellation by client(s).

If the course booking is cancelled by the client(s) (for any reason) the following cancellation charges will be applicable:

  1. Any cancellation that is more than 8 weeks before course start date; there is a 10% cancellation fee applicable to the deposit paid, this being the deposit as stated on the Shark Designs web site at the time of booking. All fees paid above the deposit fee will be refunded. i.e. There is a 10% cancellation fee applied to the deposit paid for the course, but no deductions will be made on any fees paid over and above the deposit fee paid at the time of booking.
  2. Any cancellation that is between 4 and 8 weeks before the course start date; there is a 100% cancellation fee applicable to the deposit paid, this being the deposit as stated on the Shark Designs web site at the time of booking. All fees paid above the deposit fee will be refunded. i.e. There is a 100% cancellation fee applied to the deposit paid for the course, but no deductions will be made on any fees paid over and above the deposit fee paid at the time of booking.
  3. Any cancellation that is less than 2 weeks before the course start date; there is 100% cancelation fee applicable to all fees paid to that date. i.e. no refund will be given of any fees paid.

The client(s) acknowledges that it is reasonable for such penalties to arise, given the need for Shark Designs to make preparations for a course substantially in advance of the course.

5. Course Date Changes.

Should the client(s) wish to change the dates of their course, where there is a time, date and place available, an administration fee of £20.00 will be charged to make transfer.

6. Variation of a course by Shark Designs.

A Shark Designs course is, by its very nature, exposed to natural variables, including the weather. Whilst every reasonable effort is made to deal with (indeed to learn from) such contingencies there may be occasions when Shark Designs, through no fault of its own, is forced to vary or modify a course itinerary at short notice or decides to do so in order to take advantage of natural circumstances. The client(s) acknowledges that information about courses provided by Shark Designs is given in the best of faith, but that because of the variability of nature it may be necessary or reasonable to alter or modify a course and that in such circumstances it is not reasonable for Shark Designs to be liable for any losses consequential on such a change and that Shark Designs's liability is limited accordingly.

All Shark Designs courses are taught by professional, highly experienced and capable instructors, some of whom are known to the wider public. If a Shark Designs course is described as hosted by a recognized "personality", Shark Designs accepts that the client(s) has the right to expect to meet that person and if he/she becomes unavailable the client(s) will be offered the opportunity to participate in a comparable course on another date where the recognized "personality" is available, or the client(s) will be offered the option of return of monies paid.

7. The Age of the Client(s).

The use of the word Minor is hereby used to represent anyone under the age of 18 years old.

All client(s) under the age of 18 years (i.e. a minor) must be accompanied by an adult at all times.

When booking a minor(s) onto a course the Parent, Guardian or Minder consents to, and guarantees to the following:

  1. The minor(s) is mature and sensible enough to follow the instructors tuition without disruption to the course.
  2. Any minor(s) disrupting a course will be appropriately controlled or removed from the course by the accompanying adult.
  3. If a minor is asked to leave the course for whatever reason it is understood that the minor’s Parent, Guardian or Minder must accompany the minor.
  4. The course instructor(s) is granted limited parental controlling rights over any minor(s) to verbally correct any disruptive behaviour. In the case of perceived and or imminent danger to the minor(s), or perceived and or imminent dangerous behaviour from the minor(s) the instructor(s) have the right to physically restrain the minor(s) if required.
  5. On occasions certain processes and techniques within the course’s instructional period may require that the instructor(s) need to physically contact the minor to aid the instruction.

8. Photography and Filming.

The use of the words Photograph, Photographic and Photography etcetera, will include (but are not limited to) all forms of photography and filming by whatever means.

To respect the privacy of others, Client(s) who wish to take photographs must seek full permission from the course organisers, course instructor(s) as well as all other course client(s) wherever the likeness of the course organisers, instructor(s) and client(s) will be represented in the photograph.

Under no circumstances may photographic records other than written notes any kind may be taken of (but not limited to) the course contents or anyone under the age of 18 years old without the express permission of the course organisers, instructor(s) and in the case of anyone under the age of 18 years the Parent, Guardian or Minder of the minor. Where permission is granted no photographic records shall be published in any way without written permission from Shark Designs and those involved.

Shark Designs reserves the right to make photographic records of any part or parts of a course without the permission of the client(s) except where the client(s) is under the age of 18 years old.

Shark Designs reserves all and full rights to any and all photographic records made during a course. Shark Designs has the right to publish (at any time and by any means) any photographic records made during a course, whatever its content(s) and without restriction.

9. The conduct of a course

The client(s) acknowledges that during a Shark Designs course he/she is required to submit to the reasonable instructions and leadership of Shark Designs, save that parents, teachers and those in comparable roles in respect of children must maintain control of those children, to the satisfaction of Shark Designs.

The client(s) acknowledges that any person(s) attending a Shark Designs course is entitled to expect a high standard of conduct and regard for personal well being on the part of all clients.

For this reason the client(s) accepts that Shark Designs may, in its absolute discretion and without the need to give reasons, arrange for him/her to be removed from a course, if necessary against his/ her will. Circumstances in which this might occur include (without limitation) disorderly, antisocial or abusive conduct; intoxication; failure of control over children; inadequacy of clothing or equipment; incapacity or inability to meet the rigors of the course. In such circumstances the client(s) will not be entitled to a refund of monies and Shark Designs will not be liable for any losses so resulting. The client(s) will on demand reimburse Shark Designs its reasonable costs of effecting his/her removal from the course.

In the event of perceived, apparent or actual criminal behaviour and or damage to any persons and or property belonging to Shark Designs or other clients who may be on the course, Shark Designs has a strict policy to fully cooperate with the police in such matters; and where necessary to provide any and all information by whatever means when deemed necessary or when requested by a police officer, to the police to aid in any resulting prosecution(s).

10. Liability

Shark Designs courses take place both in the open countryside as well as indoors in a workshop and whilst precautions have been made to ensure that these courses are safe, there are inherent dangers within the activities associated with each course. The client(s) will be briefed, within reasonable parameters, of any particular health and safety precautions that will need to observed, however, all activities by their very nature are not absolutely free from hazard and that safe negotiation of such risks remains. Consequently, the client(s) acknowledges that there are circumstances in which an accident could befall them without Shark Designs being at fault and accepts that to that extent he/she is taking part in a Shark Designs course at his/her own risk.

The client(s) acknowledges that a certain degree of skill is needed by the client(s) to safely operate tools and equipment needed for each course and all such tools and equipment are handled by the client(s) at their own risk.

Whilst every effort will be made by instructors to relay any and all relevant information needed to successfully complete projects or activities associated with a course, and any materials supplied will be of the upmost quality, Shark Designs cannot accept any responsibility for the outcome of such projects or activities that are beyond its control; these include (without limitation): any project or activity not being completed by the client(s) within the time constraints of the course: the relevant and necessary skills needed by the client(s) to produce a professionally finished product: the finish and presentation of the project or activity. As such the client(s) acknowledges that a certain degree of skill is needed to operate tools and equipment needed for each course. The organisers and instructors take no responsibility for injury or loss caused.

Shark Designs only accepts liability for physical injury to a client(s) that is shown to result from negligence on the part of Shark Designs.

The client(s) acknowledges that other loss, damage and expense (including, without limitation, loss of money, loss or damage to clothes and possessions, losses arising on the cancellation of a booking, the failure to arrive at, or attend, a course at the, or during, given time of the course and the expenses of delay and harm caused other than by the negligence of Shark Designs) howsoever arising is not the responsibility of Shark Designs and that Shark Designs's liability is hereby limited.

The client(s) is responsible to compensate, or replace (at our discretion) any property, tools or equipment belonging to Shark Designs that has been damaged, lost or otherwise abused by the client(s) during the course and or whilst on the property either owned or hired by Shark Designs.

Shark Designs instructors are not medically qualified to administer any form of medical aid and will not advocate, provide or administer any medical or pharmaceutical drugs whatsoever. Clients who injure themselves whilst on any Shark Designs courses, or whilst on any Shark Designs premises whether hired or owned by Shark Designs, are full responsible for their own medical care. Upon request by the client(s) any and all help will be volunteered by an instructor(s) at his or her own discretion to aid the client(s) should medical aid be required. Should the client(s) not be able to seek medical aid for him or herself due to (but not limited to) being incapacitated or unconscious in any way, the instructor(s) may at his or her discretion administer whatever medical aid he or she deems necessary at the time. It is understood by the client(s) that any medical aid or advice given by any Shark Designs, its employees, instructors or representatives is wholly given under the strict acknowledgment that no responsibility or accountability by (but not limited to) the client(s), their family, representatives or friends will be held against Shark Designs, its employees, instructors or representatives with regard to any form of prosecute, either criminal, private or civil, for any further injury caused by the administration of any medical aid given.

11. Alcoholic Drinks, Drugs & Smoking

For health and safety reasons there is a strict policy against the consumption of alcohol or any recreational drugs whilst attending any Shark Designs courses. Any client(s) considered being under the influence of alcohol or drugs will be asked to leave the course at the course instructor’s discretion, in such cases the client(s) forfeit the right to any refunds of course fees as well as any or course reassignment dates.

For health and safety reasons, smoking is strictly prohibited whilst attending any Shark Designs courses, except at designated break or meal times, where these products can be used outside in the open air.

During non-tuition periods, such as after a course has finished for the day (but not during short breaks, or during lunch breaks), clients are welcome to consume alcoholic beverages at their own discretion as long as they are over the age of 18 years old, or if under the age of 18 years they have the express permission of the parent, guardian or adult who is in their care. It is recommended that an instructor always be consulted to make sure that it is appropriate to do so.

At no time is it permitted to consume illegal recreational drugs whilst on any Shark Designs premises, either own or hired. Any client(s) caught with illegal substances will be reported to the appropriate authorities and will be asked to leave the course, in such cases the client(s) forfeit the right to any refunds of course fees as well as any or course reassignment dates.

It is understood by the client(s) that an instructor(s) may at any time, and at his or her discretion, request that the client(s) desist from either smoking or consuming alcohol whist the client(s) is on any property that is either owned or hired by Shark Designs. Clients who fail to comply with this request may be asked to leave the course and will forfeit any refunds of course fees as well as any or course reassignment dates that may be offered.

12. Complaints

In the unlikely event that a client(s) has cause for complaint about a Shark Designs course, complaint should be made to a representative of Shark Designs during the event, in order that corrective action can, if necessary, be taken. The client(s) acknowledges that it is unreasonable to take no action during a course, but to complain later. However, should a problem not be resolved, complaint should be made in writing within 28 days. To the extent permitted by law Shark Designs will not be liable in respect of claims first intimated later than 28 days from the close of the relevant course.

13. Changes to this agreement

Shark Designs reserves the right to update the Terms & Conditions at any time, without notice.
